Arrest Record Keeping

Arrest records fall under public information in North Carolina. Anyone can obtain anybody’s arrest records through the local police departments, sheriff’s office or the county Clerk of Court. However, the Criminal History Record Information (CHRI) section administered by the State Bureau of Investigation (SBI) division at the Department of Justice is the state’s central repository for criminal arrest records. Only records that are supported by fingerprints are maintained in their database.

Fingerprint-based criminal history background checks are available to criminal and non-criminal justice agencies as a Right to Review but North Carolina law requires that the latter need an ordinance, federal mandate, state statute, or Governor’s executive order. When requesting North Carolina criminal history record information through SBI, a complete set of legible fingerprints presented on a standard fingerprint card including all ten fingers accompanied by the completed official form and the $14 fee is required. Checks on third parties are restricted to authorized agencies.

North Carolina Arrest records are kept up-to-date on the local and state levels by their respective law enforcement agencies. A signed release is not necessary for accessing them but the state has about 100 counties and procedural requirements vary among them. Some may require criminal record search requests be made in person while others accept applications via phone, mail, fax or online.

The SBI process and those of local agencies do not include any criminal history information that may be maintained at the national level or by other states. Fortunately, arrest information can also be gathered through various private search sites over the Internet these days for those who may have such needs. It’s actually much faster and easier with commercial records providers as they are often excellent value for money with their multi-state searches and instant services.

The North Carolina Department of Justice maintains a record of the criminal arrests in the state and sends the same to the Federal Bureau of Investigation. These records undoubtedly can be of immense help to both the general public and the law enforcement authorities. The data is collected by the State Bureau of Investigation, an initiative of the FBI, through the UCR or North Carolina Uniform Crime Reporting program.

The program makes two broad classifications of the criminal activities and the subsequent arrests. Part 1 of the records contains reports of murder, forcible rape, burglary, larceny, non- negligent man slaughter, motor vehicle theft, robbery and aggravated assault. These arrest reports provide crucial information while preparing a crime rate report or while making a crime index. Part 2 of the program concentrates solely on arrest data and the report contains complete information of people charged for various offenses excluding incidents of traffic violation.

Deleting Personal Arrest Information

You may even come across your own arrest record. You may well be unaware of it, but there might be a warrant issued against your name. This can happen especially in cases of traffic violation. This happens when the clerk of court fails to submit a copy of the expungement order issued by the court to the Department of Correction.

A delay in submission leads to a delay in updating the records. If you are facing a similar situation, then you can contact the Public Affairs Office immediately at 1-800-368-1985 or send an email to in order to correct the entry and update the records.

Criminal records are record accounts of all activities to be processed through the criminal justice and law enforcement bureaus; so, a criminal records search is for these public records. Criminal background records are categorized by type and jurisdiction, and held at various jurisdictions to which they pertain, as subject to nature of crime, locale, and other relating factors.
